Terms of Use

Project Kirk is not an emergency service.

Kirk does not contact police, ambulance, fire services, 911, or any other emergency number. It is not a monitored alarm service. No one at Project Kirk is watching a screen waiting for your child's alert.

Alerts depend on working phones, sufficient battery, network connectivity, notification permissions being enabled, and an adult being available and willing to respond. Delivery cannot be guaranteed. A status of "Sent" means a push notification was accepted for delivery; it does not mean a person has seen it.

Kirk is a supplement to parental supervision and conversation, never a replacement for either. In an emergency, call your local emergency number.

1. Acceptance and eligibility

By creating an account or using the Project Kirk apps or this website, you agree to these Terms. If you do not agree, do not use the service.

The account holder must be at least 18 years old and must be a parent or legal guardian of every child added to the family. Adults invited as guardians or emergency contacts must also be 18 or older.

2. The service and its limits

Kirk provides: a Need Help button in the child app that alerts every adult in the family, with the child's location captured at the moment of the press; honest delivery states (Sending, Retrying, Sent, Seen); alert history with maps; unlink alerts; risk levels of Low, Medium or High; screen time summaries and app time limits where the child's platform supports them; family roles; and an interface in five languages.

Kirk does not read messages, view photos, record audio, log keystrokes, track location in the background, read contacts, log calls, or track browsing history. Availability of some features depends on the child's device platform, as set out on the Devices page.

4. Parent responsibilities

  • Use Kirk lawfully, and only in the jurisdictions where such use is permitted.
  • Confirm you have the legal right to monitor each child you add to the family.
  • Inform the child. Kirk is designed to be visible to the child and must not be used as covert surveillance.
  • Keep your account credentials secure and tell us promptly if you believe your account has been accessed by someone else.
  • Ensure the phones in your family have battery, connectivity, and notification permissions enabled, since alerts depend on them.

5. Roles and permissions

  • Main parent (owner). Controls billing, rules, children, and who has access to the family.
  • Guardian. View-only access. Sees alerts and activity and changes nothing.
  • Emergency contact. Receives Need Help alerts only. No screen time, no activity, no history.

The owner is responsible for who they invite and for removing access when it is no longer appropriate.

6. Subscriptions and billing

  • Kirk Family: $9.99 per month, up to 4 children.
  • Kirk Family Plus: $12.99 per month, up to 10 children.
  • All features are included in both plans. The plans differ only by the number of children covered.
  • Subscriptions renew automatically each month until cancelled.
  • A 7-day free trial is available on your first subscription only, once per person. Changing plans does not grant a new trial.
  • Billing is handled by Apple In-App Purchase or Google Play Billing under their terms. Kirk never receives your payment card details.
  • Cancel at any time in your App Store or Google Play account. Refunds are governed by the store's policies, not by Kirk.
  • If you need to cover more than 10 children, contact support@projectkirk.app.

7. Acceptable use

You must not:

  • Use Kirk to monitor any person you do not have the legal right to monitor. This is prohibited without exception.
  • Use Kirk covertly, or attempt to hide it from the child using it.
  • Attempt to reverse engineer, interfere with, overload, or gain unauthorised access to the service.
  • Send false emergency alerts or misuse the Need Help feature.
  • Use the service for any unlawful, abusive, or harassing purpose.

8. Intellectual property

Project Kirk and its licensors own the apps, the website, the software, the designs, and the Kirk name and marks. You receive a limited, non-exclusive, non-transferable, revocable licence to use the apps for personal, family use for as long as these Terms are in force. Nothing here transfers ownership.

9. Third-party services and platform terms

Kirk relies on Apple and Google for distribution, billing and push delivery, and on other providers listed in the Privacy Policy. Your use of the apps is also subject to the App Store and Google Play terms. We are not responsible for outages or changes in those services.

10. Disclaimers, limitation of liability and indemnity

To the maximum extent permitted by law, the service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that alerts will always be delivered, that the service will be uninterrupted, or that it will prevent harm.

To the maximum extent permitted by law, Project Kirk will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, revenue or goodwill. Our total aggregate liability for any claim relating to the service is limited to the amount you paid for the service in the twelve months before the claim arose.

Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you. Nothing in these Terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.

You agree to indemnify Project Kirk against claims arising from your unlawful use of the service or your breach of these Terms.

11. Suspension and termination

You may stop using Kirk at any time and delete your account from within the app or by contacting us. We may suspend or terminate an account that breaches these Terms, that is used unlawfully, or where required by law or by Apple or Google. Where practical we will give notice first.

12. Governing law, disputes and venue

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law rules. The parties submit to the exclusive jurisdiction of the state and federal courts located in Delaware. If you are a consumer resident in the EU, UK, or another jurisdiction with mandatory consumer protections, you keep the benefit of the mandatory rules and the courts of your place of residence.

Before starting formal proceedings, please contact us so we can try to resolve the matter directly.

13. Changes to these Terms

We may update these Terms. When we do, we will change the "last updated" date and, for material changes, notify account holders by email or in the app before the change takes effect. Continued use after the effective date means you accept the updated Terms.
